انتقال الحق في التعويض للورثة في نطاق التعويض عن الضرر المعنوي

Résumé: ملخّص: يطرح موضوع التعويض عن الضرر المعنوي إشكالات عديدة، ومن أهمها مشكلة البحث في انتقال الحق في التعويض عن الضرر المعنوي إلى ورثة المضرور المتوفي، هذه الأخيرة عرفت الكثير من الجدل والاختلاف، فانقسم الفقه والقضاء بشأنها بين رأي مؤيد لها وآخر رافض، كما تباينت مواقف القوانين المدنية بين منظم لها صراحة وبين ساكت عنها، وتهدف هذه الدراسة إلى البحث حول موقف الفقه والقضاء والقوانين المدنية من مسألة جواز اعمال مبدأ انتقال الحق في التعويض عن الضرر المعنوي الى الورثة، وكذا الإجابة على العديد من الإشكالات والتساؤلات الأخرى التي يطرحها هذا الموضوع. Abstract: The issue of compensation for moral damage posed many problems. The most important of which is the problem of researching the transfer of the right to compensation for moral damage to the heirs of the affected deceased. This topic recently has known a lot of controversy and disagreement, so the jurisprudence and the judiciary were divided between an opinion in favor of it and another that rejected it. In addition, the positions of civil laws varied between an explicit organizer and one who was silent about it. The study aims to research the position of jurisprudence, judiciary and civil laws regarding the issue of permissibility of the principle of transferring the right to compensation for moral damage to the heirs, as well as to answer many other questions and issues raised by this topic.
