أسباب الإباحة في جرائم التمييز وخطاب الكراهية

Résumé: تناولت هذه الدراسة أسباب الإباحة في جرائم التمييز وخطاب الكراهية، حيث من خلالها تم تسليط الضوء على المفاهيم الأساسية في الموضوع وعرض أسباب الإباحة التي جاء بها القانون رقم 20-05 المتعلق بالوقاية من جرائم التمييز وخطاب الكراهية ومكافحتهما، والذي حصرهافي أربع حالات كلها تدخل ضمن إطار العمل والتوظيف فيما يتعلق بالتمييز، بالإضافة إلى الاستثناءات التي جاءت بها الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، والتي تدخل في إطار الحقوق الأساسية والمجال السياسي،أما خطاب الكراهية فلا توجد نصوص قانونية لمشروعيته ولكن يبرّر خطاب الكراهية لأنه في بعض الحالات يدخل ضمن حرية الرأي والتعبير. الكلمات المفتاحية: أسباب الإباحة،التمييز، خطاب، التمييز العنصري، خطاب الكراهية. Summary This study dealt with the reasons for the legalization of discrimination crimes and hate speech, through which the basic concepts in the subject were highlighted and the reasons for the legalization of these crimes were presented as stated in Law No. 20_05 related to the prevention and combating of discrimination crimes and hate speech, which limited the reasons for legalization In four cases, all of them fall within the framework of work and employment with regard to discrimination, in addition to the exceptions made by the International Convention on the Elimination of All Forms of Racial Discrimination, which fall within the framework of basic rights and the political sphere, As for hate speech, there are no legal provisions for its legality, but hate speech is justified, Because in some cases it falls within the freedom of opinion and expression.
