توقفات الإمام مالك الفقهية وأثرها في المذهب المالكي -دراسة تأصيلية تطبيقية-

Résumé: الملخص: يتناول هذا البحث مَسْلك "التَّوقُّف" في الفتوى عند الإمام مالك ، باعتباره مسلكًا كثير الوقوع في فتاويه واجتهاداته، فكان حرياًّ بيان حقيقة التوقف ومشروعية التمسك به، وبيان مدى صلته ببعض المصطلحات العلمية التي يقوم معناها على عدم إبداء الرأي في المسألة، مع محاولة استقراء أسباب التَّوقُّف عنده، كما يتناول البحث نماذج من المسائل الفقهية التي توقَّف فيها الإمام مالك، كحُكم أكل خنزير البحر، والصّلاة خلف أهل البدع، وحُكم الكِيمَخْت، وأثرها في التَّخريج وفق أصوله وفي الاجتهاد المذهبي. Abstract : This study deals with the attitude of stopping the fatwa of Imam Malik , as a principle in his approach to the fatwa , this is by stating the fact and legality of stopping , the extent to which it relates to some scientific terms that are based on not expressing an opinion on the issue , and Search for reasons for stopping the jurists from the fatwa , the research also includes the most important jurisprudential issues in which Imam Malik stopped the fatwa , like , Eating porpoise ,prayer behind the people of innovation , skin of a dead donkey or horse Key words : Stop, imam Malik , the Maliki school , i do not know.
