تقييم التجربة الجزائرية في التحول نحو الصيرفة الإسلامية: واقع وآفاق

Résumé: Abstract : This study aimed to identify the reality of Islamic banking in Algeria, Especially after the announcement of the Prime Minister in 2018 the possibility of public banks to adopt Islamic banking work. In addition to trying to know the reforms carried out in order to create an appropriate climate for the work of riba-based banks in accordance with Islamic law, which requires laws and a legitimate body and qualified human cadres in order to do so. The study found that Islamic banking began to consolidate its presence in the financial system in Algeria until 2018, where for the first time the framework of Islamic banking is framed and regulated by legal text that was published in the Official Gazette on March 15, 2020, but without clarifying the mechanisms of work in accordance with Islamic law or specify the steps to switch to work according to them. Although Islamic banking in Algeria is not born today, it was preceded by special experiences, operating within a riba-based legal framework, starting with Al Baraka Bank and Al Salam Bank it was not enough to judge the experience of Islamic banking in Algeria. ملخص: هدفت هذه الدراسة إلى التعرف على واقع الصيرفة الإسلامية في الجزائر، خاصة بعد تصريح الوزير الأول سنة 2018 بإمكانية انتهاج البنوك العمومية للعمل المصرفي الإسلامي. بالإضافة إلى محاولة معرفة الإصلاحات التي قامت بها من أجل تهيئة المناخ المناسب لعمل البنوك الربوية وفقا للشريعة الإسلامية. وتوصلت الدراسة إلى أن الصيرفة الإسلامية بدأت في تأصيل تواجدها بالمنظومة المالية في الجزائر إلا سنة 2018، حيث ولأول مرة يؤطر وينظم مجال الصيرفية الإسلامية بنص قانوني والذي تم نشره في الجريدة الرسمية في 09 ديسمبر 2018، لكن دون توضيح لآليات العمل وفق الشريعة الإسلامية أو تحديد خطوات التحول للعمل وفقها. وبالرغم من أن الصيرفية الإسلامية في الجزائر ليست وليدة اليوم بل سبقتها تجارب خاصة، تعمل في إطار قانوني ربوي، بدءا من بنك البركة وبنك السلام والتي لم تكن كافية للحكم على تجربة الصيرفة الإسلامية في الجزائر.
