الوسائل والآليات المستخدمة في إبرام العقد الإلكتروني دراسة تأصيلية

Résumé: يتميز العقد الإلكتروني عن العقد العادي، في جزئية وسيلة إبرامه ، كما أن الفقه لم يجد شيئا في ركني المحل والسبب ، لذلك نتناول ركن التراضي الذي يتوقف على تلاقي التعبير عن إرادتين متطابقتين ، وسنركز على الجوانب التي تميزه عن غيره من العقود التقليدية بداية بصور التعبير عن الإرادة في هذا العقد وما يثيره من جدال حول قبول الوسائل الإلكترونية كأداة للتعبير وموقف القانون المدني ،أما النتائج يجب على المشرع مواكبة التطور في المجال الرقمي ، وتوفير كل الوسائل والأنترنت ،لتسريع وتيرة التعاقد بين الأفراد أو الهيئات ،و إضافة كافة وسائل التعاقد الإلكتروني في التشريع والإلتحاق بنظرائه في التشريع المقارن . The electronic contract is distinguished from the ordinary contract, in part, the means of concluding it, so we deal with the corner of consent that depends on the convergence of two identical wills, beginning with the expressions of the will in this contract and the controversy that it raises about the acceptance of electronic means as a tool of expression and the position of civil law. The legislator must keep pace with the development in the digital field, and provide all means and the Internet, to accelerate the pace of contracting between individuals or bodies, and add all means of electronic contracting in legislation and join its counterparts in comparative legislation.
