تنزيل الفروع مرتبة الأصول بين الجواز و الوجوب في قانون الأسرة الجزائري

Résumé: ملخص: يعتبر التنزيل أو الوصية الواجبة من اجتهادات واضعي القانون أتت به التشريعات العربية ومنها المشرع الجزائري تستند إلى قاعدة شرعية،ما لِوَلِي الأمر من الحق في أن يأمر بالمباح،لما يراه من المصلحة العامة،ومتى أمر به وجبت طاعته حتى يكون بإمكانه إيجاد الحلول العملية لما يعترض من مشكلات مستحدثة متعلقة بالأسرة،فشرع التنزيل لمعالجة مسألة الأحفاد كتعويض لهم عن ما فاتهم من الميراث بموت أحد والديهم في حياة جدّهم،وقد يكون الأحفاد في فقر واحتياج بالرغم أن أعمامهم يكونوا في غنى وثروة وما يجب لهؤلاء الأحفاد إنما هو وصية قانونية واجبة،وليس ميراثًا،والتنزيل بعد صدور قانون الأسرة أصبح واجبًا بحكم القانون. Abstract: The Tanzeelor the obligatory will is considered as one of the jurisprudences of the law drafters firstly brought by Arab legislations, including the Algerian legislator. The guardian has the right to order what is permissible for what he considers of publicinterest. The order must be obeyed for the sake of finding practical solutions to the emerging problems related to the family .Derived from the Sharia rule, The Tanzeelis initiated to address the issue of compensation for grandchildren for their inheritance following the death of one of their parents in the life of their grandfather. Grandchildren may be in poverty and need, even though their uncles are wealthy. What is required in this regard is a legal and obligatory willinstead of inheritance. The Tanzeel has become a duty After the issuance of Family law.
