الحق في العدول كوسيلة قانونية لحماية المستهلك

Résumé: الملخص: العدول عن العقد حق من الحقوق التي تقررت للمستهلك في العديد من التشريعات القانونية لتحقيق مصالحه، وهو استثناء على مبدأ القوة الملزمة للعقد وخاص بعقود الاستهلاك دون غيرها، ويرجع السبب في تقرير هذا الحق إلى ان المستهلك هو الطرف الضعيف في العقد الذي يفتقر للخبرة والمعرفة مقارنة بخبرة الطرف الآخر في العقد، إضافة إلى عدم وجود ما يحمي مصالح المستهلك في النظرية العامة للعقد، لذا لجأت القوانين إلى حماية المستهلك بتقرير هذا الحق. ويجد حق العدول مجاله في المرحلة التي تلي إبرام العقد، وعند قيام المستهلك باستعمال حقه في العدول عن العقد لا يلتزم بدفع أية نفقات ما عدا ما يتصل بنفقات إرجاع البضائع عند إعادتها إلى البائع على أن تكون في حالتها التي استلمها بها وقت التعاقد وبنفس الكمية، ويسأل عن تلفها أو هلاكها هلاكاً كلياً أو جزئياً، كما يلتزم البائع أيضاً برد الثمن إلى المستهلك خلال مدة زمنية معينة.
