التزام الجرّاح بالسرّ الطبّي

Résumé: الالتزام بالسرّ الطبّي واجب أخلاقي معروف منذ القدم ، بحيث تفرضه قواعد المروءة والشرف وهو واجب قانوني تقتضيه المصلحة الخاصّة للمريض والمصلحة العامّة للمجتمع، والمعلومات التي يتحصل عليها الجرّاح من خلال فحصه للمريض أو إجرائه للعملية الجراحية يجب أن يحافظ على كتمانها . وإفشاء السرّ الطبّي الجراحي سواء كان ذلك في الجراحة العامّة أو جراحة التجميل محظور من الناحية القانونية، فلولاه لامتنع المرضى عن طلب العلاج خوفا من افتضاح أمراضهم، وتشوه سمعتهم ومساسا بكرامتهم، والتأثير على مستقبلهم إلا ما استثناه القانون، كرضى صاحب السّر بكشفه أو ما تتطلبه المصلحة العامّة، من تحقيق العدالة أو المحافظة على الأمن والصحة العموميين. الكلمات المفتاحية: الالتزام ،الجرّاح ، السرّ ، الطبّي. Abstract: Adherence to medical confidentiality is a moral duty known from ancient times, as imposed by the rules of honor and honor, which is a legal duty required by the private interest of the patient and the public interest of the community, and the information obtained by the surgeon through examination of the patient or the surgery must be kept secret. The disclosure of the medical surgical secret, whether in general surgery or plastic surgery, is prohibited from the legal point of view, if it were not for patients to refrain from seeking treatment for fear of exposing their diseases, tarnishing their reputation and harming their dignity, and affecting their future except what the law excluded, such as the consent of the secret person to reveal it or what It is in the public interest to achieve justice or to maintain public security and health.
