الأحكام المتعلقة بالمولود بالتلقيح الصناعي

Résumé: الملخص : لقد تقرر شرعا أن النسب لجهة الأب يثبت بالفراش، وبالولادة لجهة الأم، هذا في حال كون الإنجاب طبيعيا، من خلال العلاقة الزوجية، وبالاتصال الجنسي بين الزوجين، ولما استحدثت أساليب أخرى للإخصاب الصناعي يعمد الناس إليها بغية الحصول على الولد، فإن تلك الأساليب أثارت تساؤلات في شأن تحديد نسب المولود من جهة الأب، ومن جهة الأم على حد سواء. وتتعقد المشكلة – بصفة خاصة- عندما يتدخل عنصر أجنبي في عمليتي الإخصاب أو الإنجاب. ونظرا لأهمية الموضوع فقد جاء هذا البحث ليجيب عن تلك التساؤلات، ويبحث الأحكام الخاصة بالمولود بالتلقيح الصناعي. Abstract In Islam, the fatherhood relation is assigned to the father based on the conjugal relationship, and motherhood is assigned by procreation or delivery. This when the birth is natural from an official marriage and a normal sexual relationship between the wife and the husband. However, the modern techniques for the artificial fertilizing have evoked new questions regarding the parentage of the child to both father's and mother's sides. The problem becomes more complicated, especially when a foreign element is involved in the fertilizing or the procreation processes. Because of the importance of the subjectm this paper tries to answer those open questions and investigates the judgments regarding a baby born as a result of an artificial fertilizing.
