الرقابة على دستورية الأوامر التشريعية بين المجلس الدستوري والمحكمة الدستورية في الجزائر

Résumé: تهدف هذه الدراسة إلى البحث في مدى خضوع الأوامر التشريعية للرقابة الدستورية، وفقا للتجربة الدستورية الجزائرية سواء قبل سنة 2020، أين كانت تخضع لرقابة المجلس الدستوري على الرغم من عدم النص عليها صراحة، وهذا ما أثبته الواقع والذي لم يكن كافيا، ما جعل المؤسس الدستوري لسنة 2020 يخصها بتعديل جوهري، إذ نص صراحة على خضوعها للرقابة الإلزامية السابقة من طرف المحكمة الدستورية This study aims to examine to what extent ordinances are subject to constitutional review, this, According to the Algerian constitutional experience, whether before 2020 when they were subject to the control of the Constitutional Council, even that they were not expressly stipulated, This has been proven by reality, which is insufficient, what prompted the legislator in 2020 to fundamentally amended it, he explicitly stated that they were subject to prior compulsory control by the Constitutional Court.
