التقعيد المقاصدي للفتوى Altqaid Al- Makassedi For Fatwa

Résumé: يعالج هذا الموضوع مدى أهمية اعتبار المقاصد الشرعية بالنسبة للفتوى ؛ سواء أكان ذلك متعلقاً باستنباط الحكم الشرعي أو بتنزيله على أرض الواقع وما يحُفُّه من قرائن وأحوال، وهي مسألة تتطلّب درجةً عاليةً من التثبّت والدّقّة والنظر وعلى مستويات عديدة، وقد حرصت في هذه الدراسة أنْ أُبيِّن أهمّ المرتكزات التي تقوم عليها الفتوى بناء على مراعاة مقاصد الشريعة والاعتداد بها، مُبْرِزاً مُسوِّغات هذا المأخذ الأصولي المصلحي بما يُظهِر مدى الحاجة إلى التقعيد المقاصدي للفتوى. كما تمّ التمثيل بفتاوى ثلاثٍ من العبادات والمعاملات حتى يتّضح من خلالها عملياً قيمة اعتبار المقاصد الشرعية عند إصدار الفتاوى، ولا سيما منها ما يتعلق بالفتاوى ذات الصبغة الجماعية لما يترتب عليها من مصلحة أو مفسدة عامة وليست خاصة. Abstract: This topic deals with the importance of considering the legitimate purposes towards Alfatwa or the legal opinions whether it comes to obtaining the legal judgement or adopting it to the ground. An issue that requires a high degree of validation and accuracy and consideration , and on many levels. In this study , I insist to show the important pillars upon which the fatwa based on the observance of the purposes and the law invoked , highlighting the rationale for this Altqaid AL- Makassedi so as to clarify our needs to Altaqaid AL-Maqassedi for Fatwa. Also , three examples of worship and transaction action have been practically used to show which practical value considered legitimate when releasing fatwa. Especially those related to collective nature fatwa of the dye because of their interest or general evil and not private.
