منهج الشريعة الإسلامية في مكافحة الفساد الوظيفي

Résumé: الفساد في مجال الوظيفة العامة ظاهرة خطيرة، تأخذ أشكالا عدة، تشكل في معظمها جرائم خطيرة تضر باقتصاد البلاد، وتخل بنزاهة الوظيفة، وقد تصدت الشريعة الإسلامية للفساد، وتوعدت كل مفسد بأشد العقاب في الدنيا والآخرة، وهذا البحث محاولة لاستخلاص منهج الشريعة الإسلامية في التصدي لظاهرة الفساد في مجال الوظيفة العامة، ومدى إمكانية تطبيق هذا المنهج في واقعنا المعاصر، والتأكيد على صلاحية أحكام الشريعة لكل زمان ومكان، وقد اقتضت طبيعة البحث اعتماد المنهج الوصفي، والاستقرائي، والتحليلي، مع مراعاة خصوصية البحث في الدراسات الشرعية، وتوثيق النصوص والآثار والحكم عليها من مصادرها الأصلية، وقد أظهر هذا البحث أسبقية الشريعة الإسلامية وشمول منهجها في مكافحة الفساد الوظيفي، حيث حددت مظاهر هذا الفساد، وتصدت له وكافحته بإجراءات وقائية، وجزاءات وعقوبات مناسبة، وقد وجد هذا المنهج طريقه في التطبيق على أرض الواقع منذ زمن النبي صلى الله عليه وسلم، وفي عصر الخلفاء الراشدين رضوان الله عليهم، وفي زماننا يمكن مكافحة الفساد الوظيفي من خلال تعظيم دور القيم والأخلاق في المجتمع بشكل عام، والتركيز على الموظف وتنمية قدراته بشكل خاص، مع تفعيل مبدأ الرقابة الذاتية والإدارية لدى موظفي الدولة، وهذه مهمة يجب أن تتضافر فيها كل الجهود والمبادرات داخل الدولة. Corruption in the field of public employment is a dangerous phenomenon, which takes several forms, most of which constitute serious crimes that harm the economy of any country and disturb the integrity of any job. Islamic law (Sharia) has tackled corruption and has vowed to severely punish corruptors in this world and the hereafter. This research paper is an attempt to extract the Islamic law approach to addressing the phenomenon of corruption in the field of public employment and the extent to which this approach can be applied in our contemporary life, affirming the validity of the provisions of Sharia for every time and place. The nature of the research required the adoption of a descriptive, inductive, and analytical approach, taking into account the specificity of the research in Islamic sharia studies, thus documenting texts and effects, and judging them based on their original sources. This research has shown the primacy of Islamic law with its all-inclusive approach with respect to combating job corruption, as it identified the manifestations of this corruption, and addressed and combated it through using preventive measures as well as appropriate sanctions and penalties. This approach has been applied on the ground since the time of the Prophet, peace be upon him, and in the era of the rightly guided caliphs, may Allah be pleased with them. As regards our time, job corruption can be combated by maximizing the role of values and ethics in society in general, focusing on the employees and developing their capabilities in particular, while activating the principle of self-censorship and administrative control among state employees, and this is a task for which there should be concerted efforts and initiatives within the country.
