النّزاعات الزّوجية وأشكال العنف الممارس ضدّ المرأة بمدينة قسنطينة أواخر الفترة العثمانية

Résumé: ملخص: يندرج موضوع النّزاعات الزّوجية والعنف الأسري ضمن القضايا الاجتماعية التي نالت حظا من البحث، وما تزال تثير اهتمام الباحثين في علم الاجتماع والحقوق والعلوم الشّرعية وغيرها من الميادين البحثية، وقد اخترنا دراسة جانب من هذا الموضوع؛ من خلال الترّكيز على النّزاعات الزّوجية وأنواع العنف الممارس ضد المرأة؛ والتي كانت غالبا في عينة البحث هي الزّوجة، وذلك بمدينة قسنطينة أواخر الفترة العثمانية. إذن هي دراسة سوسيوتاريخية نهدف من خلالها إلى معالجة إشكاليّة أساسية تتمثّل في رصد أنواع النّزاعات الزّوجية وأشكال العنف الممارس على الزّوجة؛ الموثق في سجلات المحاكم الشرعية المالكية والحنفية بمدينة قسنطينة أواخر الفترة العثمانية، وقد أظهرت الدراسة تعدد أسباب النزاعات الزوجية ، فضلا عن استمراريتها إلى ما بعد الطّلاق أحيانا، في جانب العنف ضد المرأة؛ فالواضح تنوع مظاهر العنف الممارس عليها من قبل زوجها، كما تُبين عقود السّجلات أهمّية القضاء ودوره في معالجة مثل هذه القضايا والفصل فيها. Abstract: The subject of matrimonial disputes and different forms of domestic violence is one of the social issues that has been explored and continues to interest researchers in sociology, science of law, legal sciences, sharia sciences and other research fields. We have chosen to study one aspect of this subject; by focusing on matrimonial disputes and sorts of violence against women; in the city of Constantine during the late Ottoman period, while noting that the study sample was mostly the wife. Thus, this socio-historical study aimed at addressing the fundamental problematic of monitoring different sorts of matrimonial disputes and forms of violence against wives; registered in the the Maliki and Hanafi Shariah court’s records of Constantine during the late Ottoman period. The study revealed that the multiple causes of matrimonial disputes, as well as their persistence, sometimes until after divorce, together with the violence against women; therefore, it is obvious that there is a diversity of violence manifestations against her by her husband, and the records’ contracts show the importance of the justice authority and its role in dealing with and adjudicating such cases.
