عقود التوثيق في الفقه الإسلامي وتطبيقاتها المعاصرة -الرهن والكفالة - أنموذجا

Résumé: "لقد توسع التعامل بالديون في كثير من المجتمعات، وغدا حاجة ملحة في الحياة، وهذا الانتشار الواسع للديون صاحبته صور كثيرة لتضييع الأموال، إلى درجة أن كثيرا من الناس سدوا على أنفسهم أبواب البر والإحسان، ومن جهة أخرى شهد التعامل الربوي المحرم توسعا كبيرا، وإجحافا مهولا، بدعوى صيانة الديون من التعثر المحتمل . وإن عجز المدينين أو امتناعهم عن سداد الديون أثر سلبا على العلاقات الاجتماعية بين الأطراف ذات الصلة بالدين؛ فكثرت الخصومات، وأشكال التحايل والمراوغة للإفلات من الوفاء بالالتزامات. وعلى هذا فموضوع البحث يعالج حماية الديون من خلال عقود التوثيق في الفقه الاسلامي، حيث اخترنا الرهن والكفالة أنموذجا، وقد تطرقنا إلى مفهوم عقود التوثيق والرهن والكفالة وبيان حكمهما الشرعي من خلال الكتاب والسنة والاجماع، وأبرزنا دور كلا من الرهن والكفالة في حماية " "Dealing with debt has expanded in many societies, and has become an urgent need in life.
