قاعدة الضرر يزال وتطبيقاتها في النوازل الطبية المعاصرة -نماذج مختارة-
Résumé: " يسعى هذا البحث إلى الكشف عن مختلف الآثار التي تنجم من إسقاط قاعدة"" الضرر يزال"" في نماذج من تطبيقات للنوازل الطبية المعاصرة. فحاولنا الإجابة في هذا الموضوع عن إشكالية مفادها: ما مدى تطبيق قاعدة"" الضرر يزال"" في النوازل الطبية المعاصرة وأثرها في ذلك؟ وتمت معالجة هذا الإشكال ضمن المباحث الثلاثة المُعنونَة ب: الأول: دراسة مفاهيمية لقاعدة"" الضرر يزال""، وفي الثاني: دراسة مفاهيمية للنوازل الطبية المعاصرة، أما الثالث فقد ذكر نماذج تطبيقية لقاعدة"" الضرر يزال"" في النوازل الطبية المعاصرة، وأثرها في ذلك. وذيل هذا البحث في خاتمته بمجموعة من النتائج والتوصيات من أهمها: يحد قاعدة"" الضرر يزال"" ضابطين ومجالين مهمين هما: أ ـ الضرر الذي يجب إزالته، وب ـ إزالة الضرر، ومن أهم ما يميز علاقة قاعدة"" الضرر يزال"" بالنوازل الطبية المعاصرة هو أن الطب في أصله قائم على إزالة الأضرار أو تخفيفها عن المرضى، فكان لها أثر كبير في التطبيقات المختارة للنوازل الطبية المعاصرة، وعليه لابد من القيام بإسقاط القواعد الفقهية والمقاصدية على هذه النوازل لما لها من أثر في إزالة الضرر ودفعه.""This research aims to reveal the various effects that result from dropping a rule known as'' Damage is removed'' in different models of applications of contemporary medical issues. In this topic, we tried to answer a major problem that is as follows: to what extent is the damage removed applied in medical issues and its impact on that? This issue was dealt within the three sections intitled by: first, a conceptual study of the damage is removed. Second, a conceptual study of a contemporary medical issues. Third, he mentioned applications models for the rule of damage is removed in medical issues and its impact on that. This research was concluded by set of results and recommendations such as: the damage is removed is still limited through two important aspect: A)the damage that must be removed. B) damage remove, the most important feature that distinguishes the relationship of the damage removed with contemporary medical issues is that medicine is based on removing or mitigating harm to patients. It had a great impact 0n the selected applications of contemporary medical issues. Accordingly, it is necessary to drop the jurisprudence and intentional rule on these problems, as they have an effect in eliminating harm."
