Résumé: لعنصر الخطأ أهمية كبيرة في المسؤولية الطبية ، فهي تدور معه وجودا وعدما ، إذ يعتبر الخطأ الطبي الجراحي أحد أوجه الخطأ المهني باعتباره ذلك الفعل الذي يرتكبه أصحاب المهن أثناء ممارستهم لمهنهم ويخرجون عن السلوك المهني المألوف وعن الأصول المعمول بها والمستقر عليها في تلك المهنة . وللخطأ الطبي الجراحي مميزات خاصة به ، باعتباره متصلا بممارسة مهنة من أصعب وأخطر المهن فنشاط الطبيب الجراح متصل بجسم الإنسان وحياته وهو غير معصوم من الخطأ أثناء تدخله الجراحي فقد يرتكب أخطاء تستوجب مساءلته .
