المحكمة الجنائية الدولية والجرائم البيئية المواجهة والتحديات

Résumé: تعتبر حماية البيئة في الوقت الراهن من اهم المتطلبات التي يجب ان تتضافر الجهود الدولية من اجل الاهتمام بها، كون الحفاظ على البيئة وحمايتها هو حق من حقوق الانسان الأساسية ولان ما تتعرض له البيئة من جرائم في جميع بقاع العالم يكاد لا يحصى، وهي من أخطر اشكال الجرائم المنظمة لأنها تهدد مستقبل الإنسانية لآثارها الطويلة الاجل والمدمّرة خاصة بمناسبة النزاعات المسلحة الدولية وغير الدولية وعجز القضاء الوطني في كثير من الأحيان عن معاقبة مرتكبي هذه الجرائم، وعليه تهدف هذه الدراسة الى تبيان مدى اختصاص المحكمة الجنائية الدولية بالنظر في الجرائم البيئية، وما هو دورها في إعمال المسؤولية الجنائية الدولية، في ظل التحديات التي تواجهها في سبيل التصدي لهذه الجرائم وبالتالي ما ينبغي على المجتمع الدولي القيام به لتدارك النقائص والتغلُّب على الصعوبات ، حتى تكون هذه المحكمة أكثر فعالية. The protection of the environment is currently one of the most important requirements that must be joined by international efforts to take care of it, as the preservation and protection of the environment is a fundamental human right and because the crimes to which the environment is exposed in almost all parts of the world are being subjected, and are one of the most serious forms of organized crime because they threaten the future of humanity because it threatens the future of humanity for its long-term and destructive effects, especially on the occasion of international and non-international armed conflicts and the inability of the national judiciary to often punish the perpetrators of these crimes. This study shows the jurisdiction of the International Criminal Court to consider environmental crimes, and what its role is in the realization of international criminal responsibility, given the challenges, it faces in addressing these crimes .
