الشفافية في التحكيم التعاهدي بين المستثمرين والدول

Résumé: تشكل السرية القاعدة العامة واحد أهم مقومات التحكيم التجاري وابرز عوامل استقطاب الاستثمار الأجنبي نحو الدول لما تحققه من عدم إفصاح للمعلومات وعدم اطلاع الغير على مجريات التحكيم. إلا أن دلك لا ينطبق على التحكيم الاستثماري الدولي أو ما يعرف بالتحكيم التعاهدي،حيث تسود قاعدة الشفافية والإفصاح عن المعلومات المرتبطة بالتحكيم على وفق ما أقرته الاتفاقيات والقواعد التحكيمية الدولية خاصة اتفاقية الاونسترال للشفافية في التحكيم التعاهدي بين المستثمرين والدول ،فتكون بدلك الشفافية فرصة حقيقية للمشاركة العمومية في التحكيم،فتشكل إضافة للهدف الأعم المتمثل في تقرير التنمية المستدامة من خلال الاستثمار المالي Confidentiality is one of the most important elements of commercial arbitration and highlights the factors of attracting foreign investment to States because of the fact that they do not disclose information and do not inform others about the course of arbitration.
