Résumé: يعدّ نظام الوضع تحت المراقبة الإلكترونية من أبرز الموضوعات المستحدثة في مجال السياسة العقابية، وقد أثبت هذا النظام نجاحًا في العديد من الدول من خلال علاج السلبيات الناجمة عن تنفيذ العقوبات السالبة للحرية في المؤسسات العقابية، والتي يراها البعض بيئة فاسدة لا تساعد على إصلاح المحكوم عليهم، وإنما الإضرار بهم ضررًا جسيمًا على المستوى الاجتماعي أو النفسي. يرجع ظهور نظام الوضع تحت المراقبة الإلكترونية أو السوار الإلكتروني، كثمرة لتوظيف التكنولوجيا العلمية الحديثة في مجال إعادة الإدماج الإجتماعي للمحكوم عليهم من خلال منحهم الفرصة في الانخراط في المجتمع تحت رقابة أجهزة العدالة، وهو ما يحقق العديد من الفوائد بالنسبة للمحكوم عليه. The system of placing under electronic surveillance is one of the most prominent new topics in the field of punitive policy. This system has proven successful in many countries by addressing the negative aspects resulting from the implementation of custodial sentences in penal institutions, which some see as a corrupt environment that does not help reform the convicts. Rather, harming them is a serious harm on the social or psychological level. The emergence of the system of placement under electronic surveillance, or the electronic bracelet, is due to the use of modern scientific technology in the field of social reintegration of convicts by giving them the opportunity to engage in society under the supervision of justice agencies, which achieves many benefits for the convict.
