الحماية القانونية للفيديو المنشور عبر قناة اليوتيوب ، دراسة مقارنة

Résumé: ملخص: تعتبر منصة اليوتيوب من أحدث وسائل بث الفيديوهات داخل البيئة الرقمية ، ولها دور بارز في السماح لمنتجي المصنفات السمعية البصرية وفنانو الأداء وصناع المحتوى من إبراز قدراتهم الفنية عن طريق فتح قنوات خاصة ، بعد ما كانوا يجدون صعوبة في إيجاد فرصة في نشر أعمالهم عبر الوسائل السلكية واللاسلكية من قنوات التلفزيونية والإذاعية ، ولقد قامت الاتفاقيات الدولية بحماية المنتجات السمعية البصرية ، إلا انه نجد فوارق في الأداءات المحمية من قبل هذه الاتفاقيات نظرا لتطور الإنتاج السمعي البصري بتطور الوسائل المتاحة لالتقاط الصوت والصورة ، فظهر تثبيت الصوت قبل الصورة ، ومع التطور التكنولوجي أصبح بإمكان التقاط الصوت والصورة معا عن طريق الكاميرا ، وإمكانية التعديل فيه عن طريق تطبيقات خاصة ، ونجد المشرع الجزائري واكب الاتفاقيات الدولية ، وبسط الحماية القانونية للمنتجات السمعية البصرية المنشورة عبر اليوتيوب . الكلمات المفتاحية : الفيديو ، اليوتيوب ، الاتفاقيات الدولية ، التشريع الجزائري ، الحماية القانونية Abstract: The YouTube platform is considered one of the most recent means of video broadcasting within the digital environment, and it has a prominent role in allowing producers of audiovisual works, performers and content makers to demonstrate their artistic capabilities by opening private channels, after they had difficulty finding an opportunity to spread their work through wired and wireless means. From TV and Radio channels International conventions have protected audiovisual products, but we find differences in the performances protected by these agreements due to the development of audiovisual production with the development of the means available to capture sound and image, so sound stabilization appeared before the image With the technological development, it has become possible to capture sound and image together through the camera, and the possibility of modification in it through special applications, and we find the Algerian legislator who has kept pace with international agreements, and extended legal protection for audiovisual products published on YouTube.
