رخصة البناء كآلية لضبط المحيط العمراني The Building Permit As A Mechanism To Regulate The Urban Environment

Résumé: إن مضمون فكرة ضبط المحيط العمراني جزء لا يتجزأ من النظام العام ألجمالي وهذا ما جعل أمر الحفاظ على المحيط العمراني وجماليته في المدينة من الأهداف النبيلة التي تسعى الدولة إلى تحقيقه من خلال سلطات الضبط الإداري لكن الواقع اليوم في مدننا ومحيطها العمراني أصبحت تعيش فوضى، وجمالها يكاد يختفي تماما بسبب الظواهر السلبية في البناء وعدم احترام القواعد العامة للتعمير وخاصة عقود التعمير. هذا ما جعل المشرع الجزائري يتدخل للحد من هذه الظاهرة، التي ألقت بظلالها على المواطن والمجتمع والعمران ككل، وبالتالي فإن الواجب الملقى على عاتق الدولة وهيئات الضبط الإداري التدخل للحد من هذه الظاهرة من خلال آلية الحفاظ على المحيط العمراني بواسطة الوسيلة القانونية المتمثلة في رخصة البناء والتي تعتبر رقابة إدارية قبلية قبل الشروع في البناء. Policing the urban environment is an integral part of aesthetic public order, which makes the protection of this environment and its beauty in our cities one of the important objectives pursued by the State. However, the reality of our cities today and their urban environment reflects a chaos and the aesthetic aspect may wither because of negative construction conducts and non-compliance with general housing rules, particularly housing contracts. This situation has led the Algerian legislator to intervene to mitigate this situation that has cast a dark shadow on the citizen, the society and the urban environment, as a whole. Thus, the State and the authorities in charge of the administrative police have the responsibility to intervene to mitigate this phenomenon by the protection of the urban environment by means of the legal instrument referred to here, which is the building permit, as a prior administrative control mechanism required before starting construction.
