حقوق المستثمر الفلاحي صاحب الامتياز في التشريع الجزائري

Résumé: الملخص : عرفت عملية استغلال الأراضي الفلاحية تطوراً لافتاً من حيث الإطار التشريعي المنظم لها، وذلك باعتبار القطاع الفلاحي محركاً أساسياً للتنمية والاقتصاد في أي دولة، ولعل من أبرز وأهم هذه النصوص هو القانون 10-03 المحدد لشروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، والذي جاء بنظام الامتياز. ومن هذا المنطلق حاولنا من خلال هذه الدراسة تحديد مختلف الحقوق التي جاء بها هذا القانون والنصوص التنظيمية الأخرى بالنسبة للمستثمر صاحب الامتياز. Abstract : The exploitation of agricultural lands is a remarkable development in terms of the legislative framework that regulates it, considering that the agricultural sector is an essential engine for the development and economy of any country. The most important of these texts is Law 10-03, which specify the terms and conditions of private agricultural lands of state's property, Concession system. It is in this context that we have tried through this study to determine the various rights that this law and other regulatory texts have for the concessionaire investor.
