التنظيم القانوني للالتزام الاختياري في القانونين الأردني والجزائري -دراسة مقارنة-

Résumé: الملخص باللغة العربية يستهدف هذا البحث دارسة موضوع (التنظيم القانوني للالتزام الاختياري في القانونين الأردني والجزائري – دراسة مقارنة). أن المحل في الالتزام الاختياري لا يتميز بأية خصوصية، فهو عبارة عن التزام ينصب على محل واحد، ولكن ذمة المدين تبرأ بأداء شيء آخر بدلاً منه. وكل ما في الأمر أن المدين يستطيع أن يؤدي بدلاً من ذلك أداء آخر. والخيار في الالتزام الاختياري يكون للمدين مع احترام إرادة الدائن في حال تمسكه بالمحل الأصيل وليس بوسع المدين التزامه بالبديل. Abstract: This research aims to study the subject of(legal regulation of the optional obligation) alternative in Jordanian and Algerian laws-comparative study). The shop in the optional obligation alternative does not have any privacy, it is an obligation focused one shop, but the debtor's disclaimer disowned doing something else instead. It is only that debtor can instead perform another performance, and the option in the optional obligation (alternative) is for the debtor while respecting the will of the creditor if it adheres to the original shop the debtor cannot force the alternative.
