أرشيف الجماعات المحلية في الجزائر: قراءة تحليلية لبعض النصوص التشريعية والتنظيمية

Résumé: يعتبر تسيير أرشيف الجماعات المحلية من أهم القضايا الواجب طرحها، لأنه يمثل ذاكرة وتراث كل من البلدية والولاية، الذي يضمن سرية المعلومات والوثائق من جهة، وتحقيق الشفافية الإدارية وحق المواطنين في الوصول إلى تلك المعلومات والوثائق من جهة أخرى. لذا فقد أولت الجزائر نظام الجماعات المحلية أهمية كبرى، بالاعتراف الدستوري لهـا، وترجمت ذلك في منظومتهـا القانونية المتعاقبة، حيث تم استصدار العديد من النصوص القانونية، التي حاولت إبراز مكانة الأرشيف ومسؤولية إنتاجه وتنظيمه وحفظه وتبليغه، بالإضافة إلى مختلف العقوبات التي تشتمل على إفشاء المعلومات وإتلاف الوثائق، هذا من خلال الرؤية القانونية لأرشيف البلدية والولاية في الجزائر. The management of the archives of local collectivities is one of the most important issues that must be raised, because it represents the memory and heritage of both the municipality and the state, which guarantees the confidentiality of information and documents on the one hand, and the achievement of administrative transparency and the right of citizens to access these information and documents on the other hand. Therefore, Algeria has attached great importance to the system of local collectivities, with its constitutional recognition, and translated this into its successive legal system, where many legal texts were issued, which tried to highlight the status of the archives and the responsibility for its production, organization, preservation and communication, in addition to the various penalties that include information disclosure and destruction documents, this is through the legal vision of the municipal and state archives in Algeria
