أثر تغير الظروف على سقوط الحضانة بسبب الزواج و التنازل -دراسة مقارنة في التشريعات المغاربية-

Résumé: ملخص: يتناول هذا البحث أثر تغير الظروف على سقوط الحضانة بسبب الزواج و التنازل،و وذلك من خلال نظرة على الأحكام التي سطرتها التشريعات المغاربية في المسألة، ثم بيان دور القضاء في الموازنة بين ما سطرته النصوص القانونية، والبحث عن مصلحة المحضون لتقرير ما يراه مناسبا عند النظر في دعاوى إسقاط الحضانة للأسباب المذكورة، ويمكن الجزم بأن تأثير تغير الظروف، يفرض نفسه في الموضوع، إذ يتوجب على القاضي التعامل مع هذه المستجدات وفق ما هو منصوص عليه في القانون من جهة، واستعمال السلطة التقديرية فيما هو مسموح له بذلك من جهة أخرى. Summary: This research deals with the impact of changing circumstances on the fall of custody due to marriage and waiver, through a look at the provisions of the Maghreb legislation in the matter, then the role of the judiciary in balancing what is written by the legal texts, and the search for the interest of the conmen to decide what he sees fit when considering the cases of dropping custody for the reasons mentioned. It can be argued that the effect of changing circumstances imposes itself on the subject, as the judge must deal with these developments as stipulated in the law, on the one hand, and use discretion as permitted on the other.
