دور مبدأ الاختصاص العالمي في منع الإفلات من العقاب The Role Of The Principle Of Universal Jurisdiction In Preventing Impunity

Résumé: ان من واجب الدولة التحقيق والمقاضاة عن انتهاكات حقوق الإنسان، ويقع عليها التزام بإقامة العدالة وإجراء تحقيقات فعالة واتخاذ ما يناسب من تدابير ضد مرتكبي الانتهاكات لاسيما أمام القضاء الجنائي، ومنح الضحايا مركزا قانونيا يمكنهم من رفع الدعاوى. وفي حالة فشلها يُمكن للمجتمع الدولي أن يتدخل لمنع الانتهاكات الجسيمة للقانون الدولي الإنساني والقانون الدولي لحقوق الإنسان عن طريق المحاكم الدولية، كما يُمكن لدول أجنبية أخرى ممارسة الاختصاص العالمي إزاء المتهمين للحيلولة دون الإفلات من العقاب. حيث يعتبر فشل الدول في الوفاء بالتزاماتها بالتحقيق في الانتهاكات، واتخاذ التدابير المناسبة إزاء مرتكبيها من أهم أسباب الإفلات من العقاب التي تتنافى و أهداف ومبادئ القانون الدولي. The state has a duty to investigate and prosecute human rights violations, and it has an obligation to administer justice, conduct effective investigations and take appropriate measures against perpetrators of violations, particularly before the criminal justice system, and give victims a legal status that enables them to bring cases. If they fail, the international community can intervene to prevent gross violations of international humanitarian and human rights law through international tribunals, and other foreign countries can exercise universal jurisdiction over the accused to prevent impunity. The failure of states to fulfill their obligations to investigate violations and to take appropriate measures against their perpetrators is one of the most important causes of impunity that are incompatible with the goals and principles of international law.
