تقدير القاضي الجزائي للخبرة المنجزة من الطبيب الشرعي

Résumé: إن القضاء الجزائي يستعين بكثرة بخبرة الطبيب الشرعي في فك ألغاز الجريمة خاصة تلك الماسة بسلامة الجسدية للإنسان وللدور الكبير الذي يلعبه الطبيب الشرعي في توضيح وشرح وتبيان المسائل الطبية والعلمية التي يعجز القاضي الجزائي عن فهمها بحكم تكوينه القانوني المحض مما يجعله يستعين بمعاون يقدم له تقارير مفصلة بعد الفحص والمعاينة متضمنا نتائج علمية بحتة مستخدما فيها أحدث الوسائل العلمية لاستخلاصها وبذلك يعتبر تقرير الطبيب الشرعي دليلا لارتكاب ووقوع الفعل المجرم من عدمه وبالتالي هو مستند اقناع إذا ما وجد بالملف القضائي كما انه له دور باعتباره اجراء قانوني ضروري وحتمي في جرائم العنف الجسدي وخاصة جرائم القتل العمد إضافة إلى أنه يمكن التعرف على مرتكب الجريمة من خلالها حتى الضحية. The criminal judiciary makes extensive use of forensic doctor expertise’s, in deciphering the mysteries of the crime, especially those affecting the physical integrity of the human being and the great role that the forensic doctor plays in clarifying, explaining and the medical and scientific issues; that the criminal judge is unable to understand by virtue of his pure legal composition; which makes him seek for assistance of who provides him detailed reports after examination and inspection, including purely scientific results to extract, using the most recent scientific means, thus the forensic report is considered evidence of the commission and occurrence of the criminal act, is a persuasive document which has a necessary role as an inevitable legal measure in crimes of physical if it is found in the judicial file violence especially murder. In addition, it is so possible to identify the perpetrator of the crime and even the victim through it.
