النظام القانوني للتحفيز المادي والمعنوي للموظف العمومي في الجزائر

Résumé: تهدف هذه الورقة البحثية إلى دراسة النظام القانوني لتحفيز الموظف العمومي في الجزائر، من خلال استقراء واستنباط مختلف النصوص القانونية التي وضعها المشرع في القانون الأساسي للوظيفة العمومية وغيره من النصوص التنظيمية الأخرى لتحفيز الموظف العمومي ماديا ومعنويا، والذي تبين من خلالها اقتصار التحفيز المادي لهذا الموظف على مختلف الجوانب المالية التي تتعلق براتبه وترقيته وتكوينه وتعويضاته ومنحه وحقوقه في التقاعد والحماية الاجتماعية، في مقابل اقتصار جوانب تحفيزه المعنوي على مختلف النياشين والأوسمة الشرفية والمكافآت والشارات المميزة وميداليات الاستحقاق والشجاعة وغيرها من الشهادات الوزارية التي تمنح له من قبل الجهات المختصة، أثناء حياته أو بعد وفاته، بعدما قام بتعريض نفسه للخطر أثناء تأدية مهامه، أو بعد تقديمه أعمال نوعية من شأنها خدمة الصالح العام، أو بعد تفانيه في تأدية مهامه أثناء مساره المهني. This research paper aims to study the legal system to motivate the public employee in Algeria through extrapolation and deduction of the various legal texts that the Algerian legislator has put in place in the Basic Law for the Public Service and other regulatory texts to motivate the public employee financially and morally, and through which it was found that the material motivation of this employee is limited to Various financial aspects related to his salary, promotion, training, compensation, grant, retirement rights and social protection, in exchange for his moral motivation being limited to various badges, honors, awards, distinguished badges, medals of merit, bravery and other ministerial certificates granted to him by the competent authorities, during his life or after his death After he exposes himself to danger while performing his duties, or after performing qualitative work that serves the public interest, or after his dedication to perform his duties during his career.
