دور النيابة العامة في مسألة الصلح بين إشكالات التطبيق وضرورة التغيير

Résumé: تعمل النيابة العامة على الدفاع عن المصلحة العامة باعتبارها الهيئة التي تسهر على تطبيق القانون، وتتولى النيابة العامة رفع الدعوى المرتبطة بالمصلحة العامة أو مصلحة المجتمع في حدود ماورد في القانون. لذلك جعل المشرع الجزائري النيابة العامة طرفا أصليا في جميع قضايا شؤون الأسرة، طبقا لنص المادة 03 مكرر من قانون الأسرة، الأمر الذي خول له صلاحيات تتدخل من خلالها لحماية الأسرة وحفظها من الشتات، لاسيما في قضايا فك الرابطة الزوجية، ومن ذلك مسألة الصلح بين الزوجين على وجه الخصوص. إذ تمارس هذه الصلاحيات على وجهين، إما طرفا أصليا وإما طرفا منضما في كافة إجراءات الدعوى المتعلقة بذلك وفقا لما جاء به قانون الاجراءات المدنية والادارية. Abstract: The public prosecution works to defend the public interest as the body that oversees the application of the law, and the public prosecution is responsible for filing a lawsuit related to the public interest or the interest of society within the limits specified in the law. Therefore, the Algerian legislator has made the public prosecutor's office an original party in all cases of family affairs, in accordance with the text of Article 03 BIS of the Family Code, which has given it powers to intervene to protect the family and preserve it from the diaspora, especially in cases of dissolution of the marital bond, including the issue of reconciliation between spouses in particular. These powers are exercised in two ways, either as an original party or as an acceding party in all related proceedings in accordance with the code of civil and Administrative Procedure.
