حدود الضمان لعقد التأمين على الكوارث الطبيعية في التشريع الجزائري

Résumé: تعتبر الكوارث الطبيعية من اكبر المخاطر المرتبة لخسائر معتبرة ، لهذا فرض المشرع الزامية التأمين على الأملاك العقارية من بناءات و مختلف المنشآت الصناعية و/أو التجارية بمختلف أشكالها . و من خلال هذا البحث توصلنا إلى أن المؤمن يتحمل جزء من الخسائر تخفيفا على المؤمن له، في حدود الإعفاءات المحددة قانونا للحث على المشاركة الجزئية في تحمل عبء الأضرار التي قد تنتج عن الكوارث الطبيعية و تعميمها على أكبر عدد ممكن من المتضررين. وقد حاولنا إعطاء حلولا لتوسيع مجال تغطية كل الخسائر. Natural disasters are one of the biggest risks of significant losses.Therefore,the legislator has imposed mandatory insurance on real estate properties from various industrial and / or commercial buildings and structures. Through this research, we have determined that the insurer shall bear part of the losses to mitigate the insured, within the limits of the legally defined exemptions to encourage partial participation in the burden of damage. We have tried to give solutions to expand the coverage of all losses
