حق المحكوم عليه في الرعاية الصحية في التشريع الجزائري

Résumé: بالرغم من أن المشرع الجزائري أقر بأن الرعاية الصحية حق للمحكوم عليه واجب على الإدارة العقابية القيام به مجانا ، و بنفس مستوى الرعاية الصحية للفرد العادي ،إلا أنه أغفل جانب كبير من التكفل النفسي و من الأساليب الوقائية الضرورية لتفادي إنتشار الأوبئة والأمراض داخل وخارج المؤسسات العقابية الموروثة أغلبها من الحقبة الإستعمارية ،والتي تتميز بضيق المساحة و تفشي ظاهرة الإكتظاظ . لذلك ، ومن خلال هذه الورقة البحثية نحاول تقييم ماجاء به المشرع الجزائري من أساليب وقائية وعلاجية ونفسية تستهدف علاج الحالة النفسية والعقلية والجسدية للمحكوم عليه، وتقييم دور كل الجهات المشرفة على الرعاية الصحية أمام تحديها للعراقيل الميدانية التي تميز الوسط العقابي، الذي لا يساعد على ضمان الحد الأدنى للرعاية الصحية Although Algerian law has recognized that health care is the right of the convicted person and the duty of prisons Department to do it free and at the same level of health care for the normal person, he neglected a large part of the psychological care and preventive measures necessary to prevent the spread of epidemics and diseases inside and outside prisons Inherited mostly from the colonial era, characterized by the lack of space and the phenomenon of overcrowding. This article attempts to evaluate the preventive and curative methods of the Algerian legislature and comprehensive health services aimed at addressing the psychological, mental and physical state of the convicts and assess the role of all stakeholders in health care, although the field obstacles to the closed environment do not help to ensure the minimum level of health care.
