تطهير العقار الفلاحي التابع للدولة في الجزائر – قراءة في مضمون المناشير الوزارية المشتركة المنظمة له

Résumé: ملخص : تعتبر عملية تطهير العقار الفلاحي التابع للدولة ذات أهمية كبرى لما تحققه من مكاسب قانونية واقتصادية واستثمارية واجتماعية ونقص في المنازعات القضائية من أجل ضمان الأمن الغذائي، ولا يتأتى هذا الهدف الاستراتيجي إلاّ اذا تم الاستغلال الفعلي والأمثل للأراضي الفلاحية وذلك بعد تطهير العقار الفلاحي واسترجاع الأراضي غير المستغلة واعادة توزيعها من جديد على مستحقيها. وبرغم الترسانة القانونية المنظمة لهذا القطاع إلاّ أنها لم تحقق الهدف المطلوب لحد الساعة، اذ ما يزال العقار الفلاحي غير مستقر وغير مستغل أصلا في غالبه، وهو ما دفع بوزارات الفلاحة والمالية والداخلية الى اصدار الكثير من المناشير لإعادة تنظيم وتوضيح وايجاد حلول لمشاكل ميدانية عطلت من استكمال عملية تطهير العقار الفلاحي. Abstract: The Purge of the agricultural real estate of the State is of great importance for the legal, economic, investment and social gains and lack of judicial disputes in order to ensure food security, This strategic objective can only be achieved if actual and optimal exploitation of agricultural land is carried out after the purge of the agricultural real estate and the restoration of unused land and its redistribution to its beneficiaries. In spite of the many legal texts regulating this sector, it did not achieve the required objective to date, as the agricultural real estate is still unstable and mostly untapped, which prompted the ministries of agriculture, finance and interior to issue many Circulars to reorganize and find solutions to field problems that have delayed completion.
