النظام القانوني للرقابة على الصرف في مجال الاستثمار في الجزائر

Résumé: ملخص: ملخص: مع تطور و زيادة سرعة نمو الاقتصاد العالمي في إطار العولمة و احتدام الصراع بين الدول المصدرة لرؤوس الأموال و تلك المستقبلة لها ، ظهرت فكرة الرقابة على الاستثمار كحتمية لا مفر منها، خاصة لدى دول العالم الثالث. تناولت هذه الورقة البحثية دراسة النظام القانوني للرقابة على الصرف في الجزائر في مجال الاستثمار ،حيث عالجنا من جهة، نظام الرقابة المطبق على الاستثمار الأجنبي حسب ما جاء في قانون ترقية الاستثمار الجديد، و الاحكام المدرجة في قانون المالية لسنة 2016 و قوانين أخرى، التي بموجبها منح المستثمر الأجنبي عدة ضمانات مهمة ، كتكريس لمبدأ حرية الاستثمار ، و التي وجب مقابلتها بتقييد محكم لعمليات تحويل الأموال، و من جهة أخرى ، الاستثمارات الوطنية في الخارج التي نظمها المشرع بموجب النظام 14/04 و اخضعها لنظام رقابة اكثر تشددا من الأول . Abstract: Due to the development and to the fast growth of the global economy in the context of globalization and the intensification of conflict between capital-exporting and capital-receiving countries, the idea of investment control became inevitable, especially for the third world countries. This research paper dealt with the study of the legal system of exchange control in Algeria in the field of investment, where we treated from one side, the control system applied to foreign investment according to what was stated in the new investment promotion law, the provisions included in the Finance Law of 2016 and other laws, according to which ,the foreign investor was given several important guarantees, such as consecrating the principle of investment freedom, which was also met by a tight restriction of money transfer operations .From another side, we dealt with the national investments abroad that the legislator organized under the 04/14 regulation and subjected them to a more stringent control system than the previous one mentioned above
