الصور الحديثة لعقد الاستجرار في ميزان الاقتصاد الإسلامي

Résumé: تناول هذا البحث عقد الاستجرار كونة من العقود القديمة والتي تم استخدامها في العصر الحديث بشكل موسع سواء على مستوى افراد المجتمع او على مستوى مؤسسات الدولة من خلال تقديم خدمات معينة للمجتمع كالكهرباء والهاتف وقد ابرز الباحث تطبيقات صور عقد الاستجرار المعاصرة ومن ضمنها عقود الاجارة والبطاقات الائتمانية وعقود التوريد كما تم وضع تعريف لعقد الاستجرار يوضح ان حصر الاستجرار في عقود البيع دون غيرها من العقود يضيق من مجال استخداماته مع إمكانية استخدام عقد الاستجرار في الإجارة وغيرها من العقود ، وعلية فإن استخدام لفظ عقد الاستجرار أكثر موضوعية من استخدام لفظ بيع الاستجرار . Abstract In this article, we discuss Alestejrar contract, which is one of the oldest contracts that has been used in the recent century on the level of the group of individuals or and on the level of the institutions of the state providing services to the community like electricity and telecom. The researcher has highlighted the applications of Alestejrar lease contract images, including lease contracts, credit cards, and supply contracts. A definition of the lease contract has been developed that clarifies the limitation of Alestejrar lease contracts in sales contracts without other contracts narrowing the scope of its uses with the possibility of using the lease contract in leasing and other contracts. The use of the term Alestejrar contract is more objective than the use of the Alestejrar sale term.
