النشاط الجمعوي من منظور التشريع الجزائري The Associative Activity From The Perspective Of Algerian Legislation

Résumé: إن فكرة إسهام المجتمع المدني بمختلف فعالياته في تكريس العمل التطوعي الاجتماعي فكرة متأصلة قانونيا في أغلب الحضارات الإنسانية، ولعل أبرز هذه الفعاليات في عصرنا هذا ما يسمى بالجمعيات، التي من خلالها يبرز دور المجتمع المدني سواء في التنمية المحلية بمختلف مجالاتها أو في العمل الإنساني التطوعي، وعليه سنحاول في هذه الدراسة الإحاطة بالنظام القانوني للجمعيات ونشاطها في الجزائر على ضوء القانون 12-06، وذلك من خلال محاور عدة، أولها إطار مفاهيمي للجمعيات ونشأتها القانونية في مختلف الأنظمة خاصة الأوربية منها، كما نعرض في المحور الثاني لتأسيس الجمعيات و الشروط القانونية له، لنختم بمحور تقييمي نبين فيه الحماية القانونية التي خصّت بها الجمعيات بين الحقوق والواجبات مع نظرة تقييمية للقانون 12-06 الخاص بالجمعيات. The idea of the contribution of civil society, with its various actors to dedicating social volunteerism, is a legally rooted idea in most human civilizations. Perhaps the most prominent of these events in our time is the so-called associations, through which the role of citizens arises both in local development in its various fields or in voluntary humanitarian work, and it is therefore, in this study, we will try to encompass the legal system of associations and their activities in Algeria in the light of Law 12-06, through several capters. The first chapter will e devoted to the conceptual framework of associations and their legal formation in various systems, especially in the European ones, as we’ll show, in the second chapter, the foundation of associations and its Legal conditions to with an evaluation in which we’ll demonstrate the legal protection devoted to associations between the rights and duties with an assessment overview to the law 12-06 related to associations.
