الخصومة التحكيمية في التحكيم التجاري الدولي

Résumé: شهدت الحياة التجارية على الصعيد الدولي تطورات عديدة ، انعكست بالسلب على التجار والوسط التجاري بحدوث نزاعات تجارية بين تجار وطنين مع تجار من خارج الإقليم الوطني ، و نظرا لما تفتضيه هذه الحياة من سرعة في الإجراءات حفاظا على مصالح التجار عند حدوث نزاعات بين أطراف العلاقة التجارية، بات لزاما البحث عن بدائل لفض النزاعات بعيدا عن جهاز القضاء، تفاديا لتباطء الإجراءات وطول مدة الفصل في النزاع، ومن بين هذه البدائل التحكيم التجاري كآلية لفض النزاعات بين التجار . ويعتبر كأنجح وسيلة لفض النزاعات باعتبار أن هيئات التحكيم تضم أحيانا في تشكيلتها أشخاص على دراية بالوسط التجاري تجار دوليين ، أو خبراء في الشأن التجاري ما ينعكس بالإيجاب على نوعية الأحكام التجارية في هذا الصدد. Commercial life at the international level has witnessed many developments, which have had a negative impact on merchants and the commercial community with the occurrence of commercial disputes between national merchants and merchants from outside the national territory. Given the speed of procedures that this life entails in order to preserve the interests of merchants when disputes occur between parties to the commercial relationship, It has become necessary to search for alternatives to resolve disputes away from the judiciary, in order to avoid the slowness of procedures and the long period of time for resolving the dispute. Among these alternatives is commercial arbitration as a mechanism for resolving disputes between merchants. It is considered the most successful means of resolving disputes, given that arbitration bodies sometimes include in their composition people familiar with the commercial environment, international traders, or experts in commercial affairs, which reflects positively on the quality of commercial rulings in this regard.
