الواقع التشريعي للمصنفات الرقمية في الجزائر: المفهوم والحماية

Résumé: الملخص: لقد أدى التطور التكنولوجي في مجال المعلوماتية إلى ظهور مصطلحات مستحدثة، مثل المصنفات الرقمية للتعبير والدلالة على الإنتاج الفكري المكمل للإنتاج المادي، الذي تم تحقيقه من خلال الانصراف والتحول نحو النشر الإلكتروني وصيغ أخرى منه على غرار قواعد البيانات و برامج الحاسب الآلي ومحتوى المواقع الإلكترونية، هذه الأخيرة ونظرا إلى انفتاح الدول على بعضها واعتماد إرسال شتى أنواع البيانات خلال الشبكات أصبح من السهل نشرها عبر الشبكة لتصل إلى مستعمل الشبكة في أي بقعة من العالم، ومن ثم أصبحت الشبكة تستخدم على نطاق واسع في تسويقها. هذه الطفرة التكنولوجية في مجال الملكية الفكرية كانت لها أثر وانعكاس على المنظومة القانونية الوطنية ووضعتها أمام تحد جديد، يتمثل في وجوب توفير إطار قانوني يحدد مفاهيمها ويوفر لها الحماية اللازمة حتى يستوعب خصوصيتها التي تختلف عن ما هو معمول به في مجال المصنفات التقليدية. Abstract: The technological development in the field of informatics has led to the emergence of new terminology, such as digital works for expression and indicating intellectual production complementary to physical production, which has been achieved through shifting towards electronic publishing and other forms of it such as databases, computer programs and website content, these The latter and due to the openness of countries to each other and the adoption of the transmission of various types of data through networks, it became easy to spread it across the network to reach the network user in any part of the world, and then the network became widely used in its marketing. This technological boom in the field of intellectual property had an impact and a reflection on the national legal system and put it before a new challenge, which is the need to provide a legal framework that defines its concepts and provides it with the necessary protection to accommodate its specificity, which differs from what is in place in the field of traditional works.
