المنازعة الضريبية أمام القضاء الإداري الإستعجالي

Résumé: إن العدالة الضريبية والإدارية بحاجة ماسة للحل السريع للمنازعات الضريبية، نظرا لمكانة وشخصية الإدارة الضريبية، لما تتمتع به من إمتيازات كإمتياز الأولوية الذي يضفي على أعمال الإدارة الضريبية الطابع الشرعي إلى حين مراقبتها من طرف القاضي الإداري، وامتياز يترتب عنه عدم إيقاف القرارات الإدارية التي تصدرها الإدارة الضريبية إلا بعد أمر من القاضي الإداري، لذا يعتبر المكلف بالضريبة طرفا ضعيفا أمام سلطة الإدارة الضريبية، مما يتوجب على القضاء الإداري الإستعجالي حماية حقوق ومصالح المكلف بالضريبة لما سيترتب من أضرار قد يتعذر تداركها من خلال درء الخطر الداهم المحدق له.
