البناء الدستوري في الجزائر

Résumé: ضمن برنامج الاصلاح السياسي الذي وظفته السلطة السياسية في الجزائر بعيدا عن الحراك الشعبي الذي عرفته دول المنطقة، جاء مشروع الدستور الجديد بين البحث عن كسب رضا مختلف الفواعل السياسية و الشعبية، وضرورة الخضوع للمعايير الحديثة في بناء الدساتير،ومحاولة السلطة السياسية للحفاظ على مكانتها. ورغم ما أبدته مسودة الدستور من إضافات ايجابية نسبيا من حيث تعزيز الحقوق والحريات الأساسية لكنها لم تفتأ تدعم الصبغة الرئاسوية للنظام الحاكم وتقوية هيمنة السلطة التنفيذية على باقي السلطات. Abstract: In order to accommodate the changes necessitated by the Arab Spring, the Algerian authorities set a new constitution. This last comes seeking a consensus between political and popular activists in addition to the new measures in constituions setting. In spite of the positive implications in the draft of the new constitution since it ensures rights and fundamental freedoms, still presidential interventions cast doubts as to the willingness of the authorities in curbing executive powers.
