مبدأ الملوث الدافع كأساس للمسؤولية المدنية البيئية

Résumé: ملخص: إذا كانت قواعد المسؤولية المدنية في إطارها التقليدي تعتبر نظاما قانونيا بمقتضاه يتحمل الشخص مسؤولية الأضرار التي تنشأ عن أخطائه، فإن الأضرار البيئية اليوم ونظرا لخصوصية طبيعتها، فقد فرضت استحداث نظام قانوني جديد يتناسب معها، ويرتكز أساسا على مبدأ الملوث الدافع . يعد هذا المبدأ أحد أشهر المبادئ البيئية التي تم اعتمادها كأساس للمسؤولية المدنية البيئية، ويعد بمثابة إدراك حقيقي من مختلف التشريعات ومنها التشريع الجزائري بآثار ونتائج التلوث البيئي، حيث سارعت هذه التشريعات من خلاله إلى العمل على الحد من الأضرار البيئية بتحميل المتسبب في الضرر دفع مبالغ مالية وذلك عن طريق فرض رسوم وضرائب على النشاطات الملوثة، ولأن مبدأ الملوث الدافع هو مبدأ اقتصادي النشأة فهو يساهم في تحقيق التنمية المستدامة ومن خلالها تجسيد المحافظة على البيئة . Abstract: If the rules of civil liability in their traditional framework are considered a legal system whereby a person bears responsibility for the damages that arise from his mistakes, then the environmental damage today and due to the peculiarity of its nature, has imposed the creation of a new legal system that is compatible with it, and is basically based on the principle of the polluter pays. The principle of the polluter pays is a real recognition of the consequences of environmental pollution by the legislators as well as the Algerian legislator. Where he hastened to work to reduce environmental damage by paying money By introducing means of taxation by imposing duties and taxes on contaminated activities. The polluter pays principle is an economic principle ، it contributes to the achievement of sustainable development through which the preservation of the environment.
