دعاوى الصفقات العمومية Public Transaction Cases

Résumé: تهدف الدراسة إلى التعرف على كيفية تعامل الفقه والقضاء الإداري مع المنازعات الإدارية، خصوصا الدعاوى الناشئة عن العقود الإدارية (الصفقات العمومية) سواء قبل الإبرام عن طريق دعوى الإلغاء أو في مرحلة التنفيذ عن طريق القضاء الكامل، إما بالفسخ أو التعويض أو إعادة التوازن أثناء تنفيذها، وذلك بهدف الحفاظ على حسن سير المرافق العمومية وانتظامها من جهة، والسهر على حقوق المتعاملين الاقتصاديين من جهة أخرى. Abstract: This study aims at indentifying how case law and the administrative court system deal with administrative disputes, particularly those arising from administrative contracts (public transaction), whether by a cancellation request, or during the execution phase by judicial process either by termination or by offsetting or rebalancing at the time of implementation, in order to maintain the smooth functioning and regularity of public services on the one hand, and to protect the rights of economic agents on the other.
