الشّفعة الإداريّة وفق قانون الإجراءات الجبائيّة

Résumé: تهدف الدّراسة إلى التّأصيل المفاهيميّ والقانونيّ للشّفعة الإداريّة وفق قانون الإجراءات الجبائيّة، من خلال البحث في أسسها المفاهيميّة المقرّرة في القواعد العامّة، وبيان الأسس القانونيّة لأحكامها الموضوعيّة وضوابطها الإجرائيّة؛ بغرض الوقوف على مدى موازنة التّشريع بين حفظ حقوق الخزينة العموميّة وبين احترام مبدأ العدالة الضّريبيّة وحقوق الأفراد الثّابتة قانونا في حرّيّة معاملاتهم وحماية أملاكهم، ومن ثمّ إبراز مدى مسايرة التّشريع الجبائيّ الجزائريّ لحركة التّشريع المقارن وللتحوّلات الجديدة في هذا المجال. وقد توصّلت الدّراسة إلى نتيجة أساسيّة مفادها أنّ الإدارة الجبائيّة تستبعد اللّجوء إلى ممارسة الشّفعة وتلجأ في الواقع - بما لديها من سلطة تقديريّة- إلى آليّة إعادة التّقييم. This study aims to deepen the notion of administrative preemption in accordance with the law of tax procedures by examining the general rules and the legal bases of their material provisions and procedural controls; In order to determine the extent of the legislation balancing between the preservation of the rights of the public treasury and respect for the principle of fiscal justice and the legally established rights of individuals to the freedom of their transactions and the protection of their property, and to highlight the compliance of Algerian tax legislation with the movement of comparative legislation and the new transformations in this area. The study concluded with a basic conclusion that the tax administration excludes recourse to the practice of pre-emption and in fact resorts -with its discretionary power- to the revaluation mechanism.
