الغرامة التهديدية في المادة الادارية

Résumé: الملخص: تعد الغرامة التهديدية أحد أهم أدوات جبر الإدارة على تنفيذ المقررات القضائية الإدارية خاصة ،وأن الإدارة تمتنع في الكثير من الأحيان على تنفيذ هذه المقررات على اعتبار أنها تتمتع بامتيازات السلطة العامة ، وفي هذه الدراسة سوف نتطرق إلى تعريف الغرامة التهديدية ، واهم الخصائص التي تتميز بها ، وتفرقتها عن الأنظمة المشابهة لها كالجزاء والعقوبة والتعويض ، والتركيز على أهم شروط وإجراءات تطبيقها ، ومدى فعاليتها لتحقيق الأهداف المرجوة منها Abstract: The threat penalty is one of the most important tools of administrative redress on the implementation of administrative judicial decisions, especially since the administration often refrains from implementing these decisions as it enjoys the privileges of the public authority. In this study we will discuss the definition of the threat penalty, , And separated from similar systems such as punishment, punishment and compensation, and focus on the most important terms and procedures of application, and effectiveness to achieve the desired objectives
