المسؤولية الإدارية بين الاستقلالية والتبعية: دراسة في مدى الاستقلالية عن المسؤولية المدنية في القانون الإداري الجزائري

Résumé: ورث القضاء الجزائري نظام المسؤولية الإدارية مؤكّدا على استقلاليته عن قواعد القانون المدني، ورغم دعمه بإصلاحات تشريعية إلاّ أنّه بدأ يتراجع عن ذلك مستعيرا نصوص القانون المدني، ممّا ساهم في تأسيس نظام قانوني مزدوج. وبغض النظر عن مسألة انتظام الأوضاع المقرّرة التي يراعيها في تأسيس المسؤولية على القواعد الإدارية أو المدنية أو هما معا، لابدّ من البحث المستمرّ عن الأسباب والأسانيد القانونية لهذا الموقف ومدى استجابتها للنظامين القانوني والقضائي. ورغم ذلك تبقى بعض التداخلات بين المسؤوليتين في مجال التعويض، مع ملاحظة تقريب القاضي والمشرّع بعض الحلول مع المسؤولية المدنية، ممّا يضفي خصوصية أكثر حول مفهوم استقلالية المسؤولية في القانون الإداري الجزائري. Algerian jurisprudence inherited regime of administrative responsibility, stressing of his independence from the rules of civil law, despite his support for legislative reforms, he began to reverse that by borrowing the texts of the civil code, which contributed to the establishment of a binary juridical regime. Regardless of the issue of the regularity of the prescribed positions in establishing responsibility for administrative or civil rules or both, must be constantly search the reasons and bases for this attitude and the extent of his response to the regimes; juridical and judicial. Nevertheless, some overlaps remain between the two responsibilities in the field of reparation, noting that the judge and the legislator provide some solutions to civil responsibility, which gives more specificity on the concept of independence of responsibility in Algerian administrative law.
