مقاربة قانونية بين المجلس الدستوري والمحكمة الدستورية

Résumé: لقد أدت كتابة الدساتير الى وجوب سموها على القواعد القانونية الأخرى، ومن ثم ظهرت الحاجة الى رقابة احترام الدستور والالتزام بأحكامه من قبل السلطات العامة في الدولة . تتمثل ضمان علوية الدستور في فرض رقابة على دستورية القوانين وهو ما يعتبر الضمانة الفعلية للحقوق والحريات وذلك بحمايتها، وللفصل بين السلطات وحفظ توازنها تكريسا للنظام الديمقراطي . تعد الرقابة على دستورية القوانين الوسيلة الأنجع لضمان احترام الدستور وسموه على بقية القواعد القانونية، هذه الرقابة يمكن أن تكون رقابة سياسية يعهد بها الى هيئة سياسية، أو رقابة قضائية عندما تتولاها هيئة ذات طابع قضائي . The writing of constitutions led to the necessity of their supremacy over other legal rules, and then the need arose to monitor respect for the constitution and abide by its provisions by the public authorities in the state. The guarantee of the supremacy of the constitution is to impose control on the constitutionality of laws, which is the effective guarantee of rights and freedoms by protecting them, and to separate the authorities and maintain their balance in order to enshrine the democratic system. Oversight of the constitutionality of laws is the most effective way to ensure respect for the constitution and its supremacy over other legal rules. This oversight can be political oversight entrusted to a political body, or judicial oversight when it is undertaken by a body of a judicial nature.
