الآثار القانونية لممارسة الاختصاص الجنائي العالمي

Résumé: ملخص: يعد الاختصاص العالمي إجراءا استثنائيا للعدالة الجنائية، يثير العديد من الصعوبات والإشكاليات ذات الطابع القانوني وحتى السياسي، ان الدول من خلال ممارساتها لم تكن مستعدة للتخلي عن صلاحياتها والمتمثلة في القيام بمهمة العقاب بنفسها على مستوى نظامها الداخلي، و لا سيما إذا تعلق الأمر برؤساء الدول و كل من يقوم مقامهم. كانت محكمة العدل الدولية بعيدة عن النقاش المتعلق بالمسؤولية الجنائية باعتبارها غير مختصة بتحديد المسؤولية الجنائية للأفراد. ومع ذلك أتيحت لها مناقشة الحصانة القضائية من المسؤولية الجنائية للرسميين، وبشكل محدد حصانة وزير الخارجية، في قضية " الأمر بالقبض بين الكونغو الديمقراطية وبلجيكا " في حكم صادر في سنة 2002. Abstract: The universal jurisdiction procedures exceptional criminal justice, the states any link to the accused or the acts committed by that State practice universal jurisdiction raises many difficulties and dilemmas of a legal nature, and even political, countries through its practices were not ready to give up their powers and of the task of punishment itself on the level of its rules of procedure, especially when it comes to heads of state and all of their representatives. The International Court of Justice far from the debate on the criminal liability as not competent to determine the criminal responsibility of individuals. However, given the discussion of judicial immunity from criminal liability of officials, and specifically Secretary of State immunity, in the case of "warrant between the DRC and Belgium" in a judgment in 2002.
