أثر التكنولوجيا الحديثة على مبدأ التناسب في القانون الدولي الإنساني

Résumé: الملخص تكلم هذا البحث عن مدى تأثير التقدم التكنولوجي على مبدأ التناسب. حيث تطرق إلى ظهور آليات وأساليب ووسائل جديدة للحرب، والتي تشمل أسلحة الذكاء الاصطناعي، واستخدام الروبوتات والطائرات بدون طيار، و الهجمات السيبرانية ،وغيرها من الأساليب والوسائل الأخرى. ولقد نجم عن هذه الأسلحة العديد من التحديات والإشكاليات القانونية لاسيما في مجال القانون الدولي الإنساني. تناول البحث في المبحث الأول ماهية مبدأ التناسب من خلال مطلبين، الأول يبين تعريف المبدأ في الفقه والعرف والاتفاقيات الدولية، أما في المطلب الثاني فيتم التوفيق بين مبدأ التناسب والمبادئ الأخرى المرتبطة بالقانون الدولي الإنساني. وتناول البحث في المبحث الثاني تطبيقات مبدأ التناسب في ضوء المستجدات التكنولوجية الحديثة من خلال مطلبين، يستعرض الأول إستخدامات أسلحة الذكاء الاصطناعي والطائرات بدون طيار في ضوء مبدأ التناسب، بينما يتحدث المطلب الثاني تطبيقات مبدأ التناسب على الهجمات السيبرانية. حيث تهدف الدراسة إلى فحص إمكانية حدوث إنتهاكات ناتجة عن إستخدامات التكنولوجيا الحديثة تتعارض مع مبادئ القانون الدولي الإنساني والتي يأتي في مقدمها مبدأ التناسب. Abstract This article deals with the impact of technological development on the principle of proportionality. It discusses the emergence of new mechanisms, methods, and tools of war, with artificial-intelligence-based weapons as one of most important, along with cyber-attacks, the use of robots, drones, and others. Such developments in warfare have resulted in several legal problematic issues, especially in the field of “international humanitarian law”. The article addresses first the nature of the principle of proportionality through adopted definitions in jurisprudence, custom, and international agreements. Then, it moves to compare the principle of proportionality with other principles international humanitarian law. The article also focuses on the applications of the principle of proportionality under the use of modern technologies in warfare. In doing so, it analyzes such applications with regard to the most commonly known current technologies that include artificial intelligence weapons, drones, and cyber-attacks. The article’s quest is to examine the possibilities of violating the principles of international humanitarian law, namely the principle of proportionality as a result of using such modern technologies in warfare.
