Résumé: يعتبر المحل التجاري من الأموال المعنوية المنقولة التي تكتسي اهمية بالغة على الصعيدين القانوني والاقتصادي، مما دفع بالمشرع إلى تنظيمه وتأطيره وفق قواعد خاصة في القانون وقواعد عامة واردة في القانون المدني، ويشمل المحل التجاري على عناصر بالغة الأهمية للحفاظ على نظامه القانوني والتشريعي. وقد حرص المشرع على ضرورة افراغ عقد البيع الذي هو تحت طائلة البطلان، وهو ما ذهبت اليه احكام التشريع ومن أوجب المشرع التجاري تحت طائلة البطلان عند رغبة التاجر بائع المتجر وأن يبين هذا القيد في العقد سواء من ناحية تعرضه لصعوبة البيع او عند رغبة البائع في تقويم ومعرفة عدد عملاء فيه. الكلمات المفتاحية: المحل التجاري، التشريع الجزائري، البائع، المشتري.
