إستغلال براءة الاغتراع وحماية الحق في ملكيتها دراسة مقارنة

Résumé: الملخص: تشكّل حقوق الملكية الصناعية أحد شقّي الملكية الفكرية، وتحظى بأهمية بالغة سواء بالنسبة لصاحبها أو للمجتمع. هذا وتمثل براءات الاختراع العمود الفقري للملكية الناعية، ونظرا لأهميتها من الناحية الإقتصادية، كان لزاما كفالة الحقوق المترتبة عنها، وتنظيم العلاقات الاقتصادية المنبثقة عنها. فإقرار نظام قانوني لحماية الإختراعات والحقوق الناشئة عنها تبدو مسألة جوهرية وأساسية لدى كافة الدول، غير أن الاعتراف للمخترع بحقه في الاختراع وحمايته يقتضي ألاّ يستأثر هذا المخترع باحتكار موضوع اختراعه ، بل لا بدّ من الأخذ في الاعتبار دعم المصلحة الإقتصادية العامة، وهذا ما عملت التشريعات الحديثة على تحقيقه. الكلمات المفتاحية: حقوق الملكية الفكرية، حقوق الملكية الصناعية والتجارية، براءة الاختراع، الاستغلال غير المباشر، الحماية القانونية، الاتفاقيات الدولية Résumé: Les droits de propriété industrielle constituent l’une des deux composantes de la propriété intellectuelle et revêtent une grande importance tant pour le propriétaire que pour la communauté. Les brevets sont la colonne vertébrale de la propriété industrielle, en raison de leur importance économique il était nécessaire de garantir leurs droits et de réglementer leurs relations économiques. L’établissement d’un système juridique de protection des inventions et des droits qui en découlent semble être une question fondamentale dans tous les États, mais la reconnaissance de l’inventeur de son droit à l’invention et à sa protection exige que l’inventeur ne monopolise pas exclusivement l’objet de son invention, et qu’il tiens compte de contribuer d’avantage à l’intérêt économique général, et c’est ce que la législation moderne a tenté de mettre en œuvre. Patents are the backbone of industrial property, because of their economic importance it was necessary to guarantee their rights and regulate their economic relations. The establishment of a legal system for the protection of inventions and the rights derived seems to be a fundamental issue in all States, but recognition by the inventor of his right to invention and protection requires that the inventor does not exclusively monopolize the object of his invention, and that he intends to contribute further to the general economic interest, and this is what modern legislation has attempted to implement.
