مقومات فعالية المحضر القضائي في التنفيذ

Résumé: يضطلع المحضر القضائي بمهام لا تقل أهمية عن مهام القاضي نفسه، لذلك اصطلح عليه البعض من الفقه تسمية قاضي التنفيذ، فعمل المحضر القضائي هو الركيزة الأساسية للعمل القضائي ككل من خلال قيامه بإسقاط منطوق أو فحوى السند التنفيذي على ارض الواقع، وهو عمل صعب جدا مقارنة بعمل بعض المهن الأخرى، وأثناء تأدية مهامه قد يصطدم المحضر القضائي بالعديد من المعوقات الواقعية والقانونية التي من شانها الحد من فعاليته في أداء مهامه وبالتالي الحيلولة دون التنفيذ، الأمر الذي استوجب ضرورة البحث عن مواضع الخلل ومن ثم استنباط سبل تفعيل نظام عمل المحضر القضائي في ظل الآليات القانونية والمادية المتاحة له في القانون الجزائري.
